These Terms of Service ("Terms") are a binding agreement between you and Premium Business Systems, LLC ("Premium Business Systems," "PBS," "we," "us," or "our") and govern your access to and use of the website prembussys.com (the "Site") and any content or services we make available (collectively, the "Services"). Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old and able to form a legally binding contract to engage our Services. By contacting us or requesting a consultation, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.
2. Our services
Premium Business Systems provides business advisory and consultation services — direct, one-on-one guidance drawn from real operating experience in the business of trucking, including topics such as operating authority, owner-operator setup, finding and pricing loads, dispatch and operations, hiring, and scaling. Our guidance is provided for general educational and informational purposes only (see the Advisory Disclaimer below). We do not sell downloadable products through the Site.
3. Requesting a consultation
You may contact us through the Site — by email, phone, or a request form — to enquire about a consultation. Submitting an enquiry does not create an obligation on either party. The scope, schedule, and any fees for a particular engagement are agreed separately and directly between you and us before that engagement begins. We reserve the right to decline any enquiry at our discretion.
4. Fees
No products or services are purchased or paid for directly through the Site. Where a paid consultation is agreed, the fee, payment method, and terms are set out and agreed with you individually for that engagement.
5. Advisory disclaimer — no guarantee of results
Our Services are provided for general educational and informational purposes only and do not constitute legal, financial, tax, accounting, regulatory, or other professional advice. Trucking is a regulated industry; nothing we provide replaces the official requirements of the FMCSA, USDOT, your state authorities, or other regulators, and you are solely responsible for verifying and complying with all laws and regulations that apply to your business. We make no guarantee of any particular outcome, income, or business result. Your results depend on many factors outside our control, including your own effort, capital, market conditions, and decisions. You are solely responsible for how you use and apply any information or guidance we provide.
6. Acceptable use of the Site
You agree that you will not use the Site for any unlawful, infringing, or fraudulent purpose, or in any way that could damage, disable, or impair the Site or interfere with any other party's use of it. You will not attempt to gain unauthorized access to any part of the Site or its systems.
7. Intellectual property
All content on the Site — including text, graphics, logos, and the selection and arrangement thereof — is the property of Premium Business Systems, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. The "Premium Business Systems" name and logo are our trademarks and may not be used without our prior written permission. All rights not expressly granted to you are reserved.
8. Disclaimer of warranties
The Site and all content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any content is accurate, complete, or current.
9. Limitation of liability
To the maximum extent permitted by law, Premium Business Systems, LLC and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless Premium Business Systems, LLC and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
11. Third-party links and services
The Site may reference or link to third-party websites, tools, or services that we do not control. We are not responsible for the content, products, or practices of any third party, and your dealings with them are solely between you and that third party.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, if you breach these Terms or engage in conduct we reasonably consider harmful, fraudulent, or unlawful. 13. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at info@prembussys.com so that we can try to resolve the matter informally.
14. Changes to these Terms
We may modify these Terms from time to time. When we make changes, we will update the "Last updated" date above, and the revised Terms become effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
